Recovering Compensation in a Wrongful Death Lawsuit
Missouri Revised Statutes section 537.080 defines wrongful death as the "death of a person result[ing] from any act, conduct, occurrence, transaction, or circumstance which, if death had not ensued, would have entitled such person to recover damages in respect thereof." In the state of Missouri, surviving spouses, children, and/or grandchildren are first in line to file wrongful death lawsuits, followed by parents, followed by siblings followed by representatives of the deceased's estate. The court may appoint a "plaintiff ad litem" to file on behalf of the victim if none of the above parties exist.
